Terms and conditions of sale

  1. PURPOSE AND SCOPE

1.1. These General Terms and Conditions of Sale (GTCS) govern the terms and conditions of sale of the training courses offered by ACG CyberAcademy to the Customer. Any order placed implies unconditional acceptance of these GTC, which take precedence over the Customer's documents or conditions of purchase. These GTC may be updated; the current version is always available on the websitewww.acgcyberacademy.fr. Modifications will not entitle the Customer to any compensation. 

1.2. These GCS apply solely to face-to-face training courses. These may take place on the premises ofACG CyberAcademyin rented premises or on the Customer's premises. Training courses include the sessions listed on the websitewww.acgcyberacademy.fr. 

  1. REGISTRATION AND CONTRACTUAL DOCUMENTATION

Registrations are open for as long as places are available. For a registration to be valid, ACG CyberAcademy must receive an order form and the training agreement or quotation, duly completed and stamped by the Customer. For courses organised in the French provinces or abroad, these documents must be received at least 15 days before the start of the course. 

Two weeks before the course, ACG CyberAcademy will e-mail an invitation to the designated contacts, including practical details (date, venue, times, access). ACG CyberAcademy cannot be held responsible if the invitation is not received. The training venue mentioned may be modified depending on the availability of rooms, but in the same geographical area. 

Within 10 working days of the course, ACG CyberAcademy will send the invoice and the training completion certificate to the persons designated by the Customer. The Customer is responsible for verifying the conformity of the training course. 

  1. CANCELLATION, POSTPONEMENT AND AMENDMENTS

All requests for cancellation or postponement must be made by telephone and confirmed in writing. For courses held outside these premises, if the cancellation or postponement is requested less than 30 days before the course, ACG CyberAcademy will charge the full cost. 

For courses held on its premises, in the event of postponement or cancellation : 

  • 30 working days before: 50 % of the total cost of the course. 
  • 15 working days before: 100 % of the total cost of the course. 

A participant who is unable to attend a course may be replaced by a colleague from the same company at no extra cost, subject to written notification to ACG CyberAcademy . 

In the event of justified force majeure, ACG CyberAcademy will accept that the Customer postpone the training to a future date within 12 months. ACG CyberAcademy reserves the right to cancel or postpone a course due to a lack of participants or in the event of force majeure, without compensation. 

  1. RATES AND BILLING

The registration fee covers the course, materials and coffee breaks, with lunches provided by ACG CyberAcademy. The total cost of the course is due at the start, and the invoice is issued after the session. 

Penalties will automatically apply in the event of late payment. Collection fees may also be charged. If the Customer uses a collecting body (OPCA) for payment, he must ensure that the application for reimbursement is made before the training course and that all documents are provided on time. 

  1. OUTSOURCING

ACG CyberAcademy reserves the right to subcontract all or part of the services. The Customer's obligations to ACG CyberAcademy remain in force, ACG CyberAcademy being liable to the Customer. 

  1. INTELLECTUAL PROPERTY

The materials provided during the course are the property ofACG CyberAcademy and may not be reproduced without permission. The content is protected by copyright. Any use outside the training context requires the prior agreement ofACG CyberAcademy. 

ACG CyberAcademy may use the Customer's company name and trademarks for commercial purposes without prior authorisation. 

  1. INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

Personal data provided by the Customer will be used for training purposes and may be shared with partners ofACG CyberAcademy. Customers have the right to access, modify or oppose the use of their data in accordance with the law of 6 January 1978. 

  1. SETTLEMENT OF DISPUTES

These conditions are subject to French law. Any dispute shall fall within the exclusive jurisdiction of the courts located in mainland France.
